092 BRAZILIAN JIU JITSU LIABILITY WAIVER

This Liability Waiver Agreement is entered into by and between:
092 Brazilian Jiu Jitsu (the "School") and
_ (the "Client"). If the Client is a minor, the parent or legal guardian must also sign below as the "Parent" or "Guardian" on behalf of the minor.
TERMS AND CONDITIONS
Please initial after reading and agreeing to each numbered term below. The Client, if an Adult, or the Parent/Guardian if the Client is a minor, are interchangeable for the purposes of this Agreement.
1.
CLIENT FITNESS - By signing this Agreement, the Client represents, warrants, and ensures that they have had an opportunity to observe the School’s programs prior to signing this Agreement. The Client asserts that they are physically and mentally able to take classes offered by the School, and that they are fully capable of participating in the program(s) they choose. If the Client is a minor, the Parent/Guardian affirms this on behalf of the minor.

. LIABILITY, WAIVER AND RELEASE (Part I) - The Client (or Parent/Guardian if a minor) understands and acknowledges that strict observation of the School's rules and regulations is required. The Client (or Parent/Guardian if a minor) acknowledges that participation in martial arts may involve physical contact, sudden and violent movements, and the risk of personal injury, including but not limited to head, neck, knee, joint, or spinal injuries. The Client (or Parent/Guardian if a minor) understands that cardiovascular exercise may be part of the program, and agrees that they do not have any pre-existing conditions such as heart defects or high blood pressure that would prevent their participation. The Client (or Parent/Guardian if a minor) acknowledges the inherent risks and agrees to participate at their own risk.

LIABILITY, WAIVER AND RELEASE (Part II) - The Client (or Parent/Guardian if a minor) hereby agrees to hold harmless, release, indemnify, and forever discharge the School, its officers, directors, employees, instructors, agents, and authorized representatives from any liability, claim, or loss, including loss of property, damage, personal injury, or expense incurred by the Client (or Parent/Guardian if a minor) arising from participation in any program offered by the School, including injuries or damages caused by the negligence (but not gross negligence or willful misconduct) of the School, its officers, directors, employees, instructors, agents, and authorized representatives. The Client (or Parent/Guardian if a minor) understands and agrees that they are assuming the risk of any and all injuries that they may suffer as a result of participation in any program offered by the School and waive any rights for legal actions against the School related to such injuries.
4.
BULLYING AND CONDUCT - The Client (or Parent/Guardian if a minor) understands that bullying of other students or disregard for the School’s instructions by Coaches will not be tolerated. Repeated violations of this policy may result in immediate termination of the Client’s membership. If a membership is terminated due to conduct issues, there will be no refund of membership fees.
5.
TERMINATION - This Membership Agreement may terminate upon the expiration or cancellation of the Client’s membership. Grounds for termination may include but are not limited to: bullying, disobeying coaches’ instructions, repeated late payments of tuition, or failure to comply with the School's rules. If the membership is terminated, no portion of the membership fees will be refunded.
6.
COMPLIANCE WITH LAWS - This Agreement shall be governed by the laws of the State of Texas. Any legal action arising out of this Agreement shall be filed in Midland County, Texas. The Client (or Parent/Guardian if a minor) agrees to comply with all applicable federal, state, and local laws and regulations. If any term of this Agreement conflicts with applicable law, the Agreement shall be amended to conform to such laws. The School and Client (or Parent/Guardian if a minor) agree that no modifications to this Agreement will be enforceable unless in writing and signed by both parties. This Agreement constitutes the entire agreement between the parties, superseding any prior contracts or discussions. The invalidity of any provision will not affect the remaining provisions.
7.
ACCEPTANCE OF CLIENT AND PHOTOS/VIDEOS - The Client agrees to fully comply with all terms and conditions of this Agreement, as well as the School’s rules and regulations. The School reserves the right to use photographs, videos, or audio recordings of the Client taken during classes or events for promotional, marketing, or other purposes. The Client (or Parent/Guardian if a minor) may request to opt out of media usage by notifying the School in writing. This membership is non-transferable. If a Client’s membership is suspended or terminated, no refunds will be provided, and missed classes cannot be "made up" or credited.
8.
EMERGENCY MEDICAL TREATMENT - The Client (or Parent/Guardian if a minor) authorizes the School or its agents to seek emergency medical treatment for the Client in the event of an injury or emergency. The Client (or Parent/Guardian if a minor) agrees to bear the costs of any such treatment.
